Successful WSIB and WSIAT Appeals

  • In Decision No. 612/24, OJI Legal Services appealed the WSIB’s ARO decision, which deemed the worker was able to work as a Sales Clerk working 40 hours per week at minimum wage. As a result of our appeal, the WSIAT deemed the worker unemployable due to their workplace injuries and allowed Full loss of earnings benefits to the age of 65.
  • In Decision No. 796/24, OJI Legal Services appealed the WSIB’s ARO decision, which deemed the worker was able to work as a paralegal earning $15 per hour for a 20-hour work week. As a result of our appeal, the WSIAT deemed the worker unemployable due to his workplace injuries and allowed full loss of earnings benefits to the age of 65.
  • In Decisions No. 516/24, OJI Legal Services appealed the ARO decision of June 2023. As a result, the WSIAT confirmed that the suitable occupation of the automotive service advisor is not suitable and that the worker is entitled to full LOE benefits from January 12, 2023, to the age of 65.
  • In Decisions No. 343/24, OJI Legal Services appealed the ARO decisions of November 2022 and May 2023 denying entitlement to the worker’s injuries and LOE benefits. As a result of our appeal, the worker has been granted entitlement to his right foot injury and full LOE benefits beyond May 2, 2022.
  • In Decision No. 893/23, OJI Legal Services appealed the ARO decision that the worker was capable of full-time employment. As a result of our successful appeal, our client received full LOE benefits from July 2021 to the final LOE review date of June 2024
  • In Decision No. 1386/23, OJI Legal Services appealed the ARO decision denying the workers permanent injuries and  LOE benefits from February to June 2022 and ongoing, noting the worker was able to work with the modified duties. As a result of the appeal, the Tribunal found the modified duties were not suitable and granted partial Loss of Earnings (LOE) benefits from February 15 to June 6, 2022. Once returned to the board, OJI was able to have the WSIB recognize the worker's permanent injuries and deem him unemployable, which granted him full LOE arrears benefits and FLOE to age 65.
  • In Decision No. 1440/23, OJI Legal Services appealed the ARO decision denying all the workers physical and psychological injuries and LOE benefits from November 2013. As a result of our appeal, the Tribunal accepted the worker's injuries and allowed full LOE benefits from November 2013 to June 2019. Once returned to the board, OJI was able to have the WSIB recognize the worker's psychological permanent impairment and pay her Full LOE benefits to age 65.
